All dogs must be leashed when outside of any dwelling and must be under the control of a responsible human companion at all times. No pet may unreasonably disturb, by barking or otherwise, the quiet enjoyment of the premises by other tenants and guests, or the quiet enjoyment of adjacent properties by neighbors. Each pet must comply with quiet hours. Pet feces shall be immediately picked up and disposed in an authorized garbage receptacle. Any damage to the exterior or interior of the Leased Property, grounds, flooring, walls, trim, finish, tiles, carpeting, or any stains, etc. and to any common area caused by Pet will be the full responsibility of the Tenant. Tenant agrees to pay all costs involved int he restoration to its original condition. If such damage cannot be remedied or restored, then Tenant hereby agrees to immediately pay the full expense of the replacement of the damaged items. Tenant will not leave Pet unattended for any undue length of time. If efforts to contact the Tenant are unsuccessful, Landlord or Landlord's agents may enter Tenant's apartment if there is reasonable cause to believe an emergency situation exists with respect to the Pet. Examples of an emergency situation include abuse, abandonment, or any prolonged disturbance. Tenant hereby releases Landlord (and Landlord's agents) from any and all liability for entering Tenant's apartment and for handling the Pet in such a situation. Tenant agrees to indemnify, hold harmless, and defend Landlord and Landlord's agents against all liability, judgements, expenses (including attorney's fees), or claims by third parties for any injury to any person or damage to property of any kind whatsoever caused by the Pet. If the Pet is a service animal and Tenant no longer has a qualifying disability, Landlord reserves the right to demand immediate removal of the Pet from the Premises. Tenant shall be obligated to notify Landlord if Tenant no longer has the disability that qualifies the Pet as a service animal. Landlord may assess a fee of $50.00 against Tenant for each vilation of the Addendum. However, Landlord may assess such a fee for second or subsequent violations of Tenant's obligation to clean up Pet waste only in compliance with ORS 90.302.
